ED released a Q&A on the use of Individuals with Disabilities Education Act (IDEA) Part B funds, another addressing IDEA Part C funds, and a third addressing flexibility on Part B fiscal requirements.

June 25, 2020 - ED Issues CARES Act Rule Addressing Private Schools

ED issued an interim final rule outlining how local education agencies (LEAs) must calculate the funds available for providing equitable services to students and teachers in private schools. It also updated its FAQs on equitable services.

June 24, 2020 - ED Sets August 1 Deadline for Applying for CARES Act Higher Education Emergency Relief Fund (HEERF)

This deadline targets institutions of higher education (IHEs) that did not initially apply to receive allocations from the fund.

June 19, 2020 - ED Launches Competitive Grant Program Funded by ESF

The Reimagine Workforce Preparation Grant Program (ESF-RWP) is funded through the Education Stabilization Fund (ESF), authorized by the CARES Act. The $127.5 million program is open to all states, Puerto Rico, and the District of Columbia. Applications are due August 24. The notice inviting applications is here. June 18, 2020 - ED to Hold Project SERV Funds in Reserve

The department will wait until later this year to allocate $100 million appropriated in the CARES Act.

June 17, 2020 - Interim Final Rule Hits Legal Roadblocks

Two district courts (Washington and California) preliminarily enjoined ED from implementing requirements of its interim final rule regarding student eligibility for HEERF assistance. ED will comply with the orders with regard to the affected entities but enforce the rule to the extent not enjoined.

June 9, 2020 – ED Seeks Approval for CARES Act Data Collection

ED is requesting an emergency clearance so that institutions of higher education may determine individuals’ eligibility for emergency financial aid grants under the CARES Act.

June 8, 2020 - Secretary Announces Waiver Availability for IDEA

States may request a waiver to use FY 2018 Part B grant awards under the Individuals with Disabilities Education Act (IDEA) for an additional year, as provided by the CARES Act. The announcement includes a request form.

June 4, 2020 - ED Updates Waivers for Perkins, Adult Education

The waivers extend the period of availability for FY 2018 funds to September 30, 2021.

April 28, 2020 - ED Posts Notices Inviting Applications for CARES Act Grants for States with Highest Coronavirus Burden

ED also posted (on the same page) a table with coronavirus burden calculations by state for one of the two grant competitions being implemented for high-burden states,  the Rethink K12 Education Models program. The deadline for submitting a notice of intent to apply for that program is May 19. Deadlines for the Reimagining Workforce Preparation grants have not yet been set.

April 27, 2020 - ED Releases Report to Congress on Waiver Authority Recommendations

The report, requested in the CARES Act, considers authorities under the Carl D. Perkins Career and Technical Education Act of 2006, the Elementary and Secondary Education Act of 1965, the Individuals with Disabilities Education Act, and the Rehabilitation Act of 1973.
