AGRICULTURE

Department of Agriculture (USDA) Rural Utilities Service to Host Broadband Technical Assistance (BTA) Webinar The event will take place August 13, 1:00 p.m. ET. The BTA program is funded by the IIJA through the Rural E-Connectivity (ReConnect) Program. Applications under the FY 2024 NOFO are due August 20.
 

COMMERCE

National Telecommunications Information Administration (NTIA) Continues Approving BEAD Proposals Most recently, initial proposals for the Broadband Equity, Access, and Deployment (BEAD) program were approved for Montana, Oklahoma, Vermont, Missouri, Tennessee, Arizona, Wisconsin, and Wyoming.
 
NTIA Releases 2023 Federal Broadband Funding Report An interactive dashboard allows users to view state broadband awards from multiple agencies.
 
National Oceanic and Atmospheric Administration (NOAA) Announces $105 Million for Pacific Coastal Salmon Recovery The awards are funded by the IIJA, the IRA, and FY 2024 appropriations.
 

ENERGY

Department of Energy (DOE) Updates State and Local Solution Center Webinar Schedule Topics include EV charging infrastructure, weatherization, renewable energy, energy efficiency, and more.
 
DOE Notifies Weatherization Assistance Program (WAP) Grantees of New Data Collection Fields Beginning in Program Year 2024 The data will be collected for both annual and IIJA awards.
 
DOE Selects 21 Recipients to Receive up to $190 Million in Prize and Grant Funding Through the Renew America’s Schools Program Each of the selectees will receive a $300,000 cash prize through phase one, which focuses on building teams and identifying facilities with needs for improvements. Of these prize selectees, 16 will move on to two additional phases and will enter into cooperative agreements with DOE for up to $15 million each, with plans to invest in 320 school facilities across 25 states.
 
DOE Invests $2.2 Billion for Eight Projects Across 18 States Through Upgrading Our Electric Grid and Ensuring Reliability and Resiliency (Grid Innovation Program) The projects will protect against growing threats of extreme weather events, lower costs for communities, and catalyze additional grid capacity to meet load growth stemming from an increase in manufacturing and data centers.
 
DOE Makes $63 Million Available for State and Local Governments to Expand Battery Recycling and Improve Access to Technologies for Small- and Medium-Sized Manufacturers (SMMs) The opportunity includes funds from two IIJA programs:

  • State battery collection, recycling, and reprocessing programs (Battery and Critical Mineral Recycling; $41 million available): for programs that will assist state and local governments in the establishment or enhancement of battery collection, recycling, and reprocessing
  • State Manufacturing Leadership ($22 million available): to expand access to smart manufacturing technologies and practices and high-performance computing resources for SMMs.

DOE Invests $10.2 Million in Four Projects to Improve Cost Effectiveness and Environmental Responsibility of Producing and Refining Critical Minerals and Materials A description of the projects is here.
 
DOE Awards $24 Million to Expand Existing Industrial Training and Assessment Centers (ITACs) The ITACs will deliver technical assistance to SMMs, provide learning opportunities for students and union apprentices, and offer training and upskilling opportunities for energy workers. Joint Office of Energy and Transportation (Joint Office) Updates Public Electric Vehicle (EV) Charging Infrastructure Playbook With Four New Modules The playbook now offers activities, videos, and resources on policies and incentives; regulations for zoning, codes, and permitting; procurement, ownership, and operation; and revenue and fee structures. 
 
Federal Railroad Administration (FRA) Requests Information on Challenges and Potential Improvements in Conducting a Railroad Operations Analysis for Federally Funded Railroad Projects Responses are due September 19.
 
FHWA Releases Annual Report on Funding Recommendations for FY 2024 Large Bridge Projects Through BIP FHWA recently announced the selection of FY 2024 projects totaling more than $5 billion. The report includes ratings for applications that were and were not selected for awards.

USDA Issues Discrimination Payments to More Than 43,000 Farmers, Ranchers, and Forest Landowners The IRA-funded Discrimination Financial Assistance Program provided financial assistance to applicants who experienced discrimination in federal farm loan programs and the provision of other federal resources prior to January 2021. DOE Reaches Milestone of Awarding More Than $1 Billion to States to Implement IRA Home Energy Rebates Programs Ten states have received full funding from DOE and another 22 plus the District of Columbia and one tribe have applied for full funding. More States Opting into Direct File for 2025 Filing Season Direct File was made possible by the IRA.
Following a pilot program in 12 states, Treasury and the Internal Revenue Service (IRS) announced the expansion of Direct File as a permanent offering. Connecticut is the latest state to join, following Oregon, New Jersey, Pennsylvania, and New Mexico.
 
Treasury Releases New Data on American Consumer Energy Savings Under IRA State-specific data have been released for Michigan, Ohio, Nevada, Pennsylvania, Georgia, New York, and Arizona.
 
Treasury and IRS Release IRA Statistics Taxpayers claimed more than $6 billion in credits for residential clean energy investments and more than $2 billion for energy efficient home improvements on 2023 tax returns filed and processed through May 23, 2024.

Department of Commerce (DOC) Receives 227 Applications for Second Round of Funding from Public Wireless Supply Chain Innovation Fund This round (NOFO) makes available $420 million for innovation in open radio units, which transmit and receive signals from the top of cell phone towers. The applications request a total of $2.9 billion.
 
Economic Development Administration Announces $184 Million for Recompete Program Implementation Six localities received awards in Alabama, Kentucky, Pennsylvania, Puerto Rico, Washington, and Wyoming.

USDA Accepting Applications for FY 2024 Composting and Food Waste Reduction Pilot Projects Using American Rescue Plan (ARP) funds, selected projects will test strategies for planning and implementing municipal compost and food waste reduction plans. USDA Announces Food Access and Retail Expansion Fund Funded by the ARP and offered as part of the Healthy Food Financing Initiative, the fund will provide loans, grants, and technical assistance for food retail and supply chain projects that increase access to healthy food in communities underserved by grocery stores.
 

TREASURY

Treasury Posts Webinar on Obligating State and Local Fiscal Recovery Funds (SLFRF)

Senate Committee Approves $7 Billion to Restart Affordable Connectivity Program The Senate Committee on Commerce, Science, and Transportation approved the funding as an amendment to the PLAN for Broadband Act (S. 2238). More information is available here.
 
House Ways and Means Committee Advances Bipartisan Child Welfare Bill The Protecting America’s Children by Strengthening Families Act (H.R. 9076) reauthorizes Promoting Safe and Stable Families (PSSF) and Child Welfare Services through FY 2029. It would increase mandatory funding for PSSF by $300 million over four years, starting in FY 2026. It also increases set-aside funding for the Court Improvement Program, Regional Partnership Grant, and Monthly Caseworker Visits; provides funding flexibilities; and requires that the Department of Health and Human Services (HHS) reduce the administrative burden on states by 15%. House Ways and Means Committee Approves Bill to Address State Use of Contractors for Child Support Enforcement The Strengthening State and Tribal Child Support Enforcement Act (H.R. 7906) would formally authorize the use of contractors for child support enforcement and gives tribes the same access to information. Absent congressional action, the Internal Revenue Service (IRS) has requested that child support agencies submit plans with specific timelines for mitigating contractor access to federal tax information beyond what is currently authorized in code. Senate Committee Advances Bipartisan Older Americans Act Reauthorization The Older Americans Act Reauthorization of 2024 (S. 4776) would reauthorize programs through FY 2029, with increased funding authorizations beginning in FY 2026. Additional details are here.
 
Senate Passes 2024 Water Resources Development Act (WRDA), Moves to Conference with House The House bill, which passed the chamber last month, is available here.

EPA Posts FY 2023 Environmental Education Grants Awards Totaling $3.6 Million
 
EPA and U.S. Army Announce Joint Sampling Project to Identify PFAS Contamination Near Army Installations The sampling and testing project, which is being implemented nationally, has identified a priority list of nine installations out of 235 locations. If the sampling indicates that PFAS is present in groundwater or drinking water above the new Maximum Contaminant Levels (MCLs) established by the EPA, then the Army will work with the EPA and state regulators to assess what additional actions are necessary to mitigate exposure.

CMS Releases Guidance on Medicaid Family Planning Services and Supplies The Centers for Medicare & Medicaid Services (CMS) letter provides information on state obligations related to Medicaid coverage of family planning, strategies to reduce barriers and increase access, confidentiality protections, and quality measures.

CMS Releases FY 2025 Hospital Inpatient and Long-Term Care Hospital Prospective Payment Systems Final Rule The final rule increases payment rates. Hospitals will generally receive higher payments when a patient is experiencing housing insecurity. Other updates include new social determinants of health data elements in quality reporting and increased new technology add-on payments to help improve access to new gene therapy for sickle cell disease. HUD Issues Notice of Second Offset Based on Excess HAP Reserves HUD will apply a second offset to a number of public housing agencies’ (PHAs’) calendar year 2024 Housing Choice Voucher (HCV) housing assistance payment (HAP) renewal funding allocations based on the excess amounts in PHAs’ Restricted Net Position (RNP, commonly known as HAP reserves). This will make additional funding available to prevent the termination of rental assistance for participating HCV families as a result of insufficient funding.

FCC Seeks Comment on Proposed FY 2025 Eligible Services List for E-Rate Program The program provides discounts for telecommunications, internet access, and internal connections to eligible schools and libraries. Comments close August 30.
 
FCC Releases Fact Sheet on the Impact of the Universal Service Fund (USF) Fact sheets for individual states, plus additional materials, are also available at the heading link. The Fifth Circuit Court of Appeals recently held that the current administration of the USF is unconstitutional.

Department of the Interior (DOI) Distributes $371.7 Million to State and Local Governments Through the Land and Water Conservation Fund (LWCF)

Department of Justice Publishes Final Rule on Medical Diagnostic Equipment (MDE) The rule clarifies how public entities that use MDE can meet their obligations to ensure accessibility under the Americans with Disabilities Act. It is effective October 8.
 
Bureau of Justice Statistics Publishes Report on Byrne JAG Funding in FY 2023 The report describes the steps used to calculate the Byrne Justice Assistance Grant (JAG) formula-based award amounts and presents summary results of the FY 2023 calculations.

Department of Transportation (DOT) Withdrawals Direct Final Rule on Procedures for Transportation Workplace Drug and Alcohol Testing Programs The withdrawal is in response to adverse comments. DOT issued a parallel proposed rule, which proposes the same changes as the direct final rule; DOT will respond to comments as part of any final action taken on the proposed rule.
 
Federal Motor Carrier Safety Administration (FMCSA) to Evaluate Whether Existing Guidance Documents Should be Updated or Eliminated, Invites Public Input Comments are due September 12.
